Abstract
- The article discusses a court case wherein the plaintiff was denied of his application for asylum by the Board of Immigration Appeals (BIA) in 2002. The Immigration Judge (IJ) has granted the asylum, but it was reversed by the BIA claiming that the plaintiff did not rise to the level of persecution. The First Circuit of the U.S. Court of Appeals suggests administrative court to evaluate the plaintiff according to the In re T-Z- rules since neither IJ nor BIA has applied the correct standard.
