Abstract

The article discusses the lawsuit, Dollars & Sense Finance Ltd. vs Nathan, on forgery and land registration in New Zealand. The son of the respondent has forged the signature of his parents which was used as an instrument for mortgage. The case deals on the validity of the of the mortgage considering the rules under the Torrens system. The rules of the Torrens acknowledges the validity of forgery upon registration as long as it is not fraudulent, however, fraud can only impugn the registration.
