Abstract
- The article focuses on the laws that regulate post-employment non-compete contracts for media employees. The contract restricts an employee from accepting a job at any competing place of business for one year. The contracts has been described by court as a possible form of industrial peonage. Non-compete agreements have been challenged by employees on the ground that they are unreasonable and, therefore, unenforceable under state common law. To determine whether a contract was reasonable, courts examined a variety of interdependent variables in the employee contracts.
