Abstract
- The article discusses a need for a federal right of publicity statute that would maintain the policy goals of Section 23 of the Communications Decency Act while also protecting the rights of American citizens. It explains the importance of the right of publicity in the age of the internet and the historical background and significance of the Act. It also examines the decision by an appeals court not to dismiss the lawsuit of Karen Hepp against Facebook for infringing upon her publicity rights.
