Abstract

This ai-ticle argues that the Taiwan Constitutional Court (TCC) practices what Rosalind Dixon calls "responsive judicial review. Depending on the forms of democratic derogation, the TCC has delicately manipulated the strength of judicial review by distinguishing among precedents and by employing various interpretive methods and remedies. Furthermore, the TCC has spared no e#ort in shoring up its legitimacy during its delivery of opinions. Finally, the TCC has also investigated the (non-)compliance of its decisions and adjusted its strategies accordingly. [ABSTRACT FROM AUTHOR]
