Abstract

In its decision in London Taxi Co Ltd v Frazer-Nash Research Ltd,1 the Court of Appeal has upheld a decision by the High Court in 2016 that the shape of the traditional London black cab lacked "distinctive character" and was not a "valid registered trade mark This comment will examine the possible consequences of this judgment and the difficulties faced by shape mark applicants.
