Abstract
- The article discusses the application of a heightened scrutiny standard of review to sexual orientation classifications in the wake of the U.S. Court of Appeals for the Ninth Circuit's ruling in the 2014 case SmithKline Beecham Corp. v. Abbott Laboratories which deals with an illegal peremptory strike during the voir dire process and a licensing agreement for Human Immunodeficiency Virus (HIV) medications. LGBT rights and opposition to an openly gay member of a jury pool are examined.
