Abstract
- The authors argue that patentees should be aware that, in the wake of the Great Britain High Court's ruling in the 2014 patent law case Hospira Inc. v. Genentech Inc., a claim to a product obtainable by a process will be at risk of being held invalid by a court if the particular characteristics that the process is intended to confer are not clearly specified in the patent. An obviousness patent law doctrine is mentioned, along with patentable subject matter and product-by-process patent claims.
