Abstract
- The article presents a comparison of the sufficiency, fair basis and inutility in the patent law under the Patents Act 1990 in Australia with laws of other jurisdictions including Great Britain, Europe and the U.S. It discusses various judicial decisions testing the sufficiency, fair basis and inutility in Australian law including Kimberly-Clark Australia Pty Ltd. v. Arico Trading International Pty Ltd, Genetics Institute Inc. v. Kirin-Amgen Inc. and Lockwood Security v. Doric Products.
