Abstract

The article focuses on economic-loss rule that prevents a party from suing under a breach of contract claim and post-contract-formation fraud claims in Texas. Topics discussed include the Texas Supreme Court case Formosa Plastics Corp. USA v. Presidio Eng'rs & Contractors, Inc that created an exception to the economic-loss rule, the application of economic-loss rule by courts, and Texas Supreme Court's decision in case Southwestern Bell Telephone v. DeLanney that used independent injury tests.
