Abstract

The article discusses the U.S. Supreme Court case McBurney v. Young on whether Virginia state precludes citizens of other states from enjoying the same right of access to public records. It notes the petition of Mark McBurney and Roger Hurlbert, residents of Rhode Island and California, respectively, after they are being denied for their requests for public records. The law is based under the Privileges and Immunities Clause of Article IV and the Dormant Commerce Clause of the Constitution.
