Abstract

An essay is presented that explores the potential implications of civil lawsuits challenging the secret government surveillance programs. Topics discussed include the U.S. Supreme Court's ruling on the case of Clapper v. Amnesty International USA, the Foreign Intelligence Surveillance Act (FISA) Amendments Act of 2008 that authorizes mass electronic surveillance and the National Security Agency (NSA) surveillance programs disclosed by computer professional Edward Snowden.
