Abstract
- The article compares the U.S Fair Debt Collection Practices Act (FDCPA) claims on validity of the underlying debt from claims arising out of debt collectors' conduct in relation to collection of a debt. Topics discussed include application of abstention doctrine in the FDCPA cases throughout the federal court system, court case Rail Road Commission of Texas v. Pullman Co. and Supreme Court case Burford v. Sun Oil Co. It suggests application of abstention doctrine in consumer FDCPA cases.
