The Transitional Period of the Agreement on a Unified Patent Court provides for the options to still use the national courts or to opt out of the competence of the UPC. Both options raise a number of questions which are discussed in this Article and which reveal that the two options are complicated and possibly dangerous for one or both sides of the patent litigation.
