Abstract
- The Transitional Period of the Agreement on a Unified Patent Court provides for the options to still use the national courts or to opt out of the competence of the UPC. Both options raise a number of questions which are discussed in this Article and which reveal that the two options are complicated and possibly dangerous for one or both sides of the patent litigation. The author advises not to make use of these options but to rely on the advantages of the UPCA. [ABSTRACT FROM PUBLISHER]
