Actual Problems of Development of the Institution of Criminal Complicity.

Abstract

The article examines trends in the development of joint criminal activity because of worsening socio-political crisis in Ukraine. The most dangerous manifestation of complicity in the crime today -- is separatist activities in Crimea and other regions of Ukraine. It is proved that group or collective activity (spontaneous -- in the commission of criminal acts crowd, or organized -- in the commission of crimes by criminal organizations as a hierarchically structured robust criminal associations) are the forms of joint criminal activity. It is determined that the increased risk of public crimes, which is a necessary complicity, is taken into account in the design of the main elements of a crime, because the forced character provides a joint commission of a criminal act. Solution to the «actual compatibility», which in some sense similar to complicity is proposed in the article. At the legislative level by amending the changes to Art. 26 of the Criminal Code liability for actual participation (joint) for causing harm to the victim with violence should be addressed.
