Abstract

The article discusses the court case, Clapper v. Amnesty International, as a challenge to a U.S. Constitutional amendment, section 702 of the 2008 Foreign Intelligence Surveillance Act (FISA). It offers details of the litigation challenging the provision, the dismissal on standing grounds by a New York City federal judge in 2009, and the disagreement by the Second Circuit Court of Appeals. It explains the Supreme Court's majority and dissenting opinions in its February 26, 2013 decision.
