Abstract

The article presents a discussion of the rights of the holder of money that is part of a discussion which is designed to clarify the changing character of money. The paper is therefore not focused on an exhaustive treatment of the rights and implied duties of the money holder, but concentrates upon some particular aspects of these rights, those, namely, which seem to exhibit clearly and perhaps typically the change in the function of money that is taking place in the present period of economic development. There are any number of points of departure for the purpose of establishing the theoretical framework within which one hopes to arrive at some meaningful answer. One might ask, for instance, who the holders of money are. If this question is added to the query, what are the holders of money doing with the money, one wonders how to appraise the significance of their operations and of their position. Neither can one trust implicitly the theoretical tools with which are provided for this purpose by received doctrine.
