Abstract

The article demonstrates termination-of-pregnancy legislation in South Africa to the extent where women can terminate first- and second-trimester pregnancies on demand and for socio-economic reasons. A common law starts at birth and requires that the child must be separate from the mother's body and must survive independently of the mother after separation. It informs that the Choice Act both advances and limits female reproductive rights. It mentions that South Africa is in the process of successfully balancing the opposing custom of female reproductive rights and foetal interests.
