The article looks at the works of professor Paul-André Crépeau which focus on laws and relations among patients, physicians, and health institutions in Québec. It retraces the origins of the debate concerning the qualification of relationships between a patient and a health establishment by commenting on the founding of each proposed responsibility regime. It demonstrates that this controversy is based on an hospital's irresponsibility for a physician's fault.
