Abstract
- The article discusses a court case concerning Slovakia's violation of the European Union (EU) law obligation of non-discriminatory third party access to the network. According to the Court's ruling, priority access of Slovakia was protected under the principle of the Treaty on the Functioning of the European Union (TFEU) despite committing itself towards the foreign investor before its accession to the EU. The conflict between the rights of foreign investors and the EU law is discussed.
