Abstract

The article discusses the role of fair trade in marketing strategy and statutes legalizing fair trade pricing, or resale price maintenance, in the United States. The Miller-Tydings Amendment to the Sherman Antitrust Act ensured that resale price maintenance agreements, supported by state law, could not be challenged in interstate commerce, but made no reference to nonsigner clauses in state legislation. Topics include the Supreme Court case of Old Dearborn Distributing Company v. Seagram-Distillers Corporation, the Fair Trade Act of Illinois, General Electric versus Macy's, the Schwegmann decision that made fair trade price structures based on nonsigner clauses invalid, and the New York price war in 1951.
