Abstract
- The article investigates the extent of the fair use exception under Section 52(1)(ab) of the 1957 Copyright Act when applied to computer software as a work of art in India. The right to decompile, as practiced in several countries and enactments, is compared with the Indian stand. It cites the insufficiency and poor drafting of the statutory guidelines. It concludes that unless narrowed down in its scope, the exception may be used to invent liability for infringement of copyrighted software.
