Abstract
- The article discusses the need for the development of an alternative legal framework that could help understand the nature and problem of sex inequality in the U.S. It explores the defects inherent in the approach of the Title VII of the Civil Rights Act of 1964 to anti-discrimination in employment, and suggests the use of the gender ideology as an important concept in addressing sex inequality in courts. Moreover, it contends that the addition of a sexual orientation category can lead courts to adhere to a surface-level sameness/difference discourse in sex equality legislation.
