Abstract

The article discusses the court case Ricci v. DeStefano which leads to several disturbing questions about employment and equal protection in the U.S. It explains the anti-subordination and anti-classification principle and how the case changed the definition of disparate treatment. It also cites the limitations on the scope of the case in aspects of vested rights and race-consciousness and the impossibility of relief used by Ricci that makes the Title VII and Equal Protection Clause unworkable.
