Abstract
- The article discusses reckless and gross negligence manslaughter in the context of English law. It is stated that gross negligence manslaughter looks at the actus reus component of a crime while reckless manslaughter considers the mens rea factor of a crime. The author calls for a more refined criteria that clearly differentiates gross from reckless. He concludes that crime and punishment should be equal to the moral culpability of the offender.
