Abstract

The article provides information on laws and issues related to franchising. The main elements which define a franchise include appreciable affinity with a trademark, payment of charges for the right to carry out a business, and notable control by franchisor on the marketing plan. The laws related to franchising in various U.S. states including New York and California are discussed. Common issues related to franchising include infringement, vicarious liabilities and trade secrets protection.
