Abstract
- The article explores the controversies surrounding the implementation of the Product Liability Directive in relation to the Hepatitis C litigation in Great Britain. It highlights the decision of Burton J. in A v. national Blood Authority in which it noted the problem of the nature of a defective product and the operation of the development risk defence. It also explains the issue of a defective hepatitis blood in Burton J.'s decision.
