Abstract

This article deals with the copyright-infringement lawsuit filed by French photographer Patrick Cariou against Richard Prince and his dealer Larry Gagosian. According to Prince, the use of his photographs of Rastafarians for a recent series of paintings is protected under the fair use doctrine in the U.S. The lawsuit, filed in New York, alleges that the defendants made unauthorised use of images from Cariou's 2000 book "Yes Rasta." Particular focus is given to the defendants' answer to Cariou's suit.
