Abstract

The text explores a case law regarding the prohibition of online sale of medicinal products in the EU. It focuses on the classification of services provided on websites as "information society services" and analyzes the case of Doctipharma, a service connecting pharmacists and customers for the sale of non-prescription medicinal products. The court examines whether this service falls under the concept of an information society service and whether Member States can prohibit it based on national legislation. The text concludes that if the service is distinct from the sale itself, it cannot be prohibited under Directive 2001/83. [Extracted from the article]
