Abstract

This article examines the jurisdiction flaw in the Mavrommatis Palestine Concessions case and its relevance to current territorial claims in historic Palestine. The case involved a dispute between Greece and Britain over the Mandate for Palestine, with Greece arguing that it was a treaty. The article questions the classification of the Mandate as a treaty and explores Britain's legal capacity to enter into such a treaty. It suggests that a thorough analysis of the Mandate and Britain's status in Palestine could help resolve contemporary claims to territory in the region. The article also discusses the legal status of the Mandate, Britain's authority in Palestine, and the sovereignty of the territory.
