BOC Aviation responds in Air Europa lawsuit.

Abstract
- Singapore-based lessor BOC Aviation has denied that it is obligated to return fees paid by Spanish carrier Air Europa for undelivered Boeing 787-9s. In 2018, Air Europa and BOC Aviation entered into a financing and lease transaction for four aircraft, with BOC Aviation assuming the obligation to purchase the aircraft and covering 100% of the pre-delivery payments (PDP). Air Europa later refused to continue paying commitment fees, leading BOC Aviation to terminate the lease agreements. BOC Aviation argues that the payment obligations were originally Air Europa's and that the structure of the deal allowed the airline to benefit from BOC Aviation's capital.
