- 1. Contract ClaimsIn Epic Games v. Apple, Inc.,[650] the Ninth Circuit rejected Epic's defense of illegality in a breach of contract action.[651] Epic stipulated that it breached the contract at issue by implementing an upgrade to its app to allow it to process in-game transactions outside of Apple's payment software,[652] but it argued that the contract was illegal, void against public policy, and unconscionable.[653] Because the court found that Epic's defense rested on its rejected Sherman Act claims, it affirmed the rejection of the illegality defenses.[654] [Extracted from the article]
