Abstract

Tennessee has passed the Ensuring Likeness, Voice, and Image Security Act (ELVIS Act) in an attempt to regulate the potential harm of generative artificial intelligence (AI) to musicians and recording artists. The ELVIS Act amends the state's right of publicity statute to include persons' voices within the scope of their publicity rights, creating new rights of action against the unauthorized use of one's voice. However, the law does not mention AI explicitly. The ELVIS Act has raised concerns about its impact on expressive works protected by the First Amendment and potential federal preemption issues.
