Abstract

The U.S. Supreme Court has declined to review the constitutionality of the 2020 Horseracing Integrity and Safety Act (HISA), which created the Horseracing Integrity and Safety Authority (HISA) to regulate medication control and racetrack safety in thoroughbred horseracing. The Act has faced challenges in the Sixth Circuit, with parties filing a petition for a writ of certiorari. Although the Supreme Court initially denied certiorari, a petition for rehearing has been filed based on a ruling by the Fifth Circuit that found the Act to be unconstitutional due to its delegation of enforcement power to private actors.
