Abstract

A recent Supreme Court ruling has established that landowners can bring claims of nuisance against water companies for discharging sewage into waterways. This ruling overturns the widely held belief that the Water Industry Act of 1991 protects private water companies from legal claims. The decision opens the door to potential claims for both trespass and nuisance derived from the unauthorised discharge of sewage.
