Abstract

The article discusses the legal issues related to pay-to-stay statues of U.S. states, particularly the provisions allowing the seizure of inherited property to recompense for a person's incarceration costs. Also cited are the claim that property seizure is an interference by states on a decedents' freedom to choose their beneficiaries, and the alleged disadvantages of said statutes like perpetuating a cycle of poverty and reducing the urgency of decarceration.
