Abstract

The Biden administration has launched an online portal for patients and healthcare workers to report potential violations of the Emergency Medical Treatment and Active Labor Act (EMTALA) by hospital emergency departments. EMTALA, which guarantees the right to receive medical care during life-threatening emergencies, has gained increased importance since the overturning of Roe v. Wade in 2022. The Department of Justice is currently defending its interpretation that EMTALA preempts state-level abortion restrictions.
