Abstract

Chechnya tells an incredibly intriguing tale of legal pluralism. From its political inception 'til the promulgation of its 2003 Constitution, and from thereon out, Chechnya - qua a semi-autonomous Republic within the Russian Federation -has known a multitude of different rulers, religions, and political systems. These have had a direct influence on its law-making capacity, hinging on its sources and its goals. The purpose of this article is to take into account these fluxes, and see whether, in light of the multiple stages of change Chechnya has been subsumed under, it could at once, or does now, qualify as an Islamic Law State: that is, a State whose population is majoritarily Muslim and whose legal system demands a mandatory implementation of Islamic law.
