Abstract

The German Federal Administrative Court has ruled that break times under stand-by duty are not automatically considered working time under the Working Time Directive. The court stated that the worker's obligation to be on call must significantly restrict their ability to organize their time and pursue their own interests for it to be classified as working time. The court also found that a provision in German working time law, which credits break times during on-call duty as working time, is incompatible with the Directive. The court ruled in favor of a police officer who claimed financial compensation for break times under stand-by duty. [Extracted from the article]
