Abstract

The article discusses the new Texas Data Privacy and Security Act (TDPSA), which aims to protect consumer personal information. The TDPSA, similar to the General Data Protection Regulation (GDPR) in the European Union, establishes regulations for the handling of personal data by real estate brokerage firms. The law defines personal data broadly and includes sensitive personal data. It outlines the obligations and prohibitions for controllers and processors of personal data, as well as consumer rights, such as the right to access, correct, delete, and opt out of the processing of personal data. The TDPSA applies to businesses that process or engage in the sale of personal data and are not considered small businesses. The Texas Attorney General will enforce the law, with penalties of up to $7,500 per violation. Real estate brokerage firms should consult with legal experts to ensure compliance with the TDPSA.
