Abstract

The fact that inter-human relations find their expression in the manifestations of the virtual environment is a social reality that cannot be ignored and that requires legal regulation, because these technologies provide new opportunities for the respect of human rights and for socioeconomic development. Thus, the counterbalancing of two fundamental rights, namely the right to private life and the right to free expression, presents incidences in the field of civil law, by involving tortious civil liability, as a result of the commission of an illegal act in cyberspace. The purpose of this article is to identify some situations in judicial practice, when the institution of civil liability was put into question, related to a damage suffered through an illegal act.
