Abstract

Family reunification or family reunion became a key form of migration towards Europe. Because there is no definite mention regarding the right to family reunification in the European Convention of Human Rights, the Court has the task to give guidelines in its judgements. The author argues that the Court's jurisprudence turned out to be very limited in its protection of migrants, and tried to conform the Member States' own migration policies with the right to respect for family life. The author highlights that the case law of family reunification developed with contradicting cases and this underlines the sensitive issue of migration in the immigration policy of the states.
