Abstract

The article discusses the preemption statute in the U.S. by analyzing the history and evolution of the Atomic Energy Act (AEA) and the ruling by the U.S. Supreme Court in the case Virginia Uranium, Inc. v. Warren. Topics include the decision's affirmation of the states' authority to ban traditional uranium mining, and the Navajo Nation's exercise of its power under the Diné Natural Resource Protection Act (DNRPA) as example.
