Abstract

The article discusses the South African Labor Court case Motale v The Citizen 1978 (Pty) Ltd related to dismissal of an employee. It states that Labour Court made a finding that the dismissal of an employees was invalid on the basis of the employer's to comply with its contractualnoted that declared that the decision of the respondent to terminate the applicant's contract of employment was a breach of the employment contract.
