Abstract
- The article discusses the decision of 9th Circuit court in the case "de Fontbrune v. Wofsy" involving photographs of Pablo Picasso's artwork and French copyright judgments which provides the first definitive appellate ruling on whether U.S. judges weighing dismissal motions may consider foreign law. It mentions that the court concluded that courts are not restricted to the parties' briefs and may indeed conduct independent inquiries on foreign law even when cases are at the pleading stage.
