Abstract

The authors argue that the American police practice of arresting protesters and other residents for municipal ordinance and state civil law violations, which is also known as civil arrest, is unconstitutional and unlawful under the Fourth Amendment to the U.S. Constitution. Police shooting-related protests in places such as St. Louis County, Missouri in the twenty-first century are examined, along with peaceful assembly-related civil infractions and America's search and seizure laws.
