Abstract

The article discusses U.S. copyright law-related moral rights in relation to the legal aspects of art ownership and the legal rights of artists as of 2016. According to the article, moral rights are derived from the le driot moral 18th century French legal concept which deals with non-economic, spiritual, and personal interests in creative works. The 1979 California Art Preservation Act and the 1976 U.S. Copyright Act are examined, along with America's 1990 Visual Artists Rights Act.
