Abstract: The article analyzes the current law concerning patentable subject matter under section 101 of the United States Patent Act in relation to the U.S. Supreme Court decisions in Ass'n for Molecular Pathology v. Myriad Genetics, Inc. and Mayo Collaborative Servs. v. Prometheus Labs., Inc. It provides an overview of patent law and examines the impact of the decisions on biotechnology companies. It also addresses the requirements for patentable subject matter under section 101.
