During the last years an assiduous attention is given to the issues of ensuring asylum seekers' rights. Since the State Border Guard is the first institution coming into contact with asylum seekers it has undisputable role in observing asylum seekers rights. The EU member state successfully provide the establishment of a common asylum system, which defines asylum seekers rights according to the principles of democratic and law government states with respect of definitions and criterion defines in international legal provisions. The defined scope of asylum seekers' rights is sufficient in Latvia and sometimes it creates barriers for effective asylum application processing and also serves as a basis for "malicious" use of asylum procedure. One of the most important issues is detention of asylum seekers. When detaining an asylum seeker it is important to estimate the necessity of detention with person's rights to freedom. At the same time it is important to remember about persons who use asylum procedure for malicious purposes and ensure that asylum procedure does not lose its primary meaning. The main thing is to ensure proportion between asylum seekers and state and observation of rights of the rest of the society.
