Abstract
- The article discusses a court case Poly flor Ltd v Health and Safety Executive presented at the Court of Appeal of Great Britain where Polyflor's technical support engineer broke his arm while undertaking a maintenance work on a conveyor belt. The Court of Appeal found that the accident was caused by the foolish act of the employee but still regarded existence of a risk created by the employer. It informs that Polyflor was also prosecuted by the Health and Safety Executive.
